By the indictment found and returned by the grand jury of the county of Siskiyou on November 5, 1936, defendants John H. Brite and Coke Brite, brothers, were jointly accused by said indictment, in three separate counts, with having on August 30, 1936, in said county, murdered three persons, to wit: Martin Lange, Joseph Clark and Fred Seaborn, respectively. Said Martin Lange and Joseph Clark, and each of them, were on said day deputy sheriffs of the county of Siskiyou, and Captain Fred Sea-born was, or had been, connected with the military or naval service of the United States.
