This action was tried in the superior court of Oklahoma county on appeal from an order of the board of county commissioners of Oklahoma county, and was prosecuted under what is known as the “Drainage Act,” which went into effect March 23, 1909. Chapter 32, Comp. Laws 1909.

The cause was tried, commencing on December IS, 1909, to a jury, and resulted in a verdict and judgment in favor of defendant in error in the sum of $650.
