Error from the District Court of Logan County. Action brought in the probate court of Logan county on the 2d day of January, 1893, by defendant in error against plaintiff in error to recover the sum of $300.15. On the 16th day of February, 1893, the case was tried by a jury and a verdict rendered in favor of the plaintiff for the sum of $267.89. Defendant brings error. The facts are stated in the opinion.

Judgment was rendered in the probate court for defendant in error, plaintiff in the court below, on the 16th day of February. 1893, for the sum of $267.89. On the 1st day of March, 1893, the plaintiff in error gave notice of appeal to the district court, and on the 17th day of February, 1893, entered into an appeal bond as required by § 5255, Oklahoma Statutes, 1890, with the exception that but one surety was on the bond.
