This case is an outgrowth or side issue of the ease of Burnham v. Edwards, 125 Okla. 272, 257 Pac. 788. In that case Burnham was sued on a contract of suretyship growing out of his signing a super-sedeas bond. He was the losing party in the trial court; he gave notice of an appeal to this court and had an order entered staying execution and superseding the judgment, pending the filing of a supersedeas bond.
