Stiles, J. —

This was the second trial of the appellant for the crime of murder. The first trial was reviewed by this court, and is reported in 2 Wash. 358.

The record shows that after the former judgment of conviction was reversed and a new trial granted, and on the 17th day of July, 1891, the grand jury of King county presented a second indictment against the appellant, which was identical in substance with the one sustained by the decision of this court, with the exception that, whereas, the name of the person killed was in the former indictment laid…
