Hough, J. —
The defendant was indicted for murder in the first degree, for the killing of one Chas. Powell, and was tried and convicted of murder in the second degree.
In a difficulty at a disreputable house in Chillicothe, on the night of the 27th of July, 1878, the deceased was stabbed and mortally wounded, and on the 14th day of September following, died of the wounds then received.
