1Opinion of the CourtHenry, J.

— The defendant was indicted for the murder of Americus V. Lawrence, and convicted of murder in the first degree. On the appeal to the St. Louis Court of Appeals, the judgment on that verdict was affirmed, and he has appealed to this court.

The principal ground of complaint is that the court *20failed to instruct the jury in regard to murder in the second degree. It is difficult to determine under our statute and decisions what is murder in the second degree, and the difficulty is attributable in part to the misapplications of the terms “ malice ” and “ premeditation,” and partly to those…
