This is an action to recover the purchase price remaining unpaid upon the sale of land in Aitkin county. There was a trial before Gunderson, J. and a verdict of $23,414.46 for the plaintiffs. The defendants appeal from an order, Carroll A. Nye, J. who reviewed the case after the death of Judge Gunderson, denying their motion for a new trial. The case ivas here before and was decided upon a point not going to the merits of the controversy. 168 Minn. 39, 209 N. W. 896.
