MARKS, J.—This

is an appeal from a judgment refusing plaintiff recovery of $100 paid as a city license, under the terms of a license ordinance of Santa Maria, permitting her to solicit and take orders for goods manufactured in Cincinnati, Ohio, and delivered in Santa Maria.

The ordinance provides for a license of $20 per quarter for a solicitor who has been in business at least one year, but five times that amount for one who has been in business for less than that time. It also provides for a refund of four-fifths of the larger amount at the end of one year if the solicitor- stays in business…
