HORN, Judge.
This case comes before the court on the parties’ cross-motions for summary judgment, pursuant to Rule 56 of the Rules of the United States Court of Federal Claims (RCFC). Plaintiffs complaint alleges that defendant, the United States, acting through the United States Department of the Army, neglected to provide plaintiff, Mary E. Su-makeris, with notification of her former husband’s election to withdraw from participation in the Survivor Benefit Plan established in 10 U.S.C. § 1447 et seq. (1988).
