OPINION
RAMSEY, District Judge.
The United States brought this action against the SCM Corporation (hereinafter “defendant” or “SCM”) at the request of the Administrator of the Environmental Protection Agency (hereinafter “EPA”). The action, brought pursuant to 42 U.S.C. § 7413(b), seeks injunctive relief and the imposition of civil penalties as a result of defendant’s alleged violations of the Clean Air Act, 42 U.S.C. § 7401 et seq., and the State Implementation Plan approved by the EPA pursuant to the Act.
