This opinion addresses defendant’s motion for summary judgment filed on March 1, 1993 and plaintiff’s cross-motion for partial summary judgment on liability filed March 29, 1993. Oral argument was held on August 3, 1993.

After an ordinary solicitation and sealed bid process, the Veterans Administration Medical Center (VAMC) in Huntington, West Virginia, on September 29, 1986, awarded a contract for ambulance service to plaintiff, Ceredo Mortuary Chapel, Inc.
