TROUT, Justice.

This is an appeal from a legal malpractice action brought by Fairway Development Company (Fairway) against the law firm of Petersen, Moss, Olsen, Meacham & Carr (Petersen). Fairway filed suit against Petersen on December 12, 1991 alleging Petersen committed malpractice by failing to appeal tax claims through the proper administrative channels. The district court dismissed Fairway’s malpractice claim on summary judgment.
