This is an appeal from a judgment rendered against the defendant as surety on the bond of a partnership which had contracted to build certain macadamized roads in Allen county.
The commissioners of roads and highways of Iola township entered into a written contract with Albert Abrams and Theodore F. Strickland, a partnership, for the building of two stretches of macadamized road in Iola township for a stated consideration.
