MEMORANDUM OPINION AND ORDER

This matter comes before the court on defendant’s motion to dismiss plaintiffs amended complaint pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure. Plaintiffs seek recovery in contribution for a judgment entered against them in prior litigation in this court. Jurisdiction is based on diversity of citizenship. 28 U.S.C. § 1332. Defendant Pelican International Inc. (“Pelican”) contends that plaintiffs cannot state a claim upon which relief could be granted because Colorado’s Proportionate Fault Statute prevents proof…
