MEMORANDUM OPINION AND ORDER

Defendants, First Interstate Bank of Denver, N.A. (FIB or First Interstate) and Refco Group, Ltd. (RGL), Refco, Inc. (RI), Refco Capital Corporation (RCC), Refco Securities, Inc. (RSI) (collectively, REFCO) have moved for dismissal of various claims of plaintiff, the Federal Deposit Insurance Corporation (FDIC), as receiver for Jefferson Bank & Trust (JBT or Jefferson Bank).
