Appeal from a judgment of the County Court of Albany County (Breslin, J.), rendered August 8, 2002, upon a verdict convicting defendant of the crimes of robbery in the first degree and robbery in the second degree.
On the evening of November 18, 2001, four individuals robbed the “Corner Store,” a convenience store located at 20 North Manning Boulevard in the City of Albany. Following their arrests, Luther Harris, Myava Murphy and defendant were charged in a two-count indictment with robbery in the first degree and robbery in the second degree.
