Appeal from a judgment of the Supreme Court (Lamont, J.), rendered September 17, 2002 in Albany County, upon a verdict convicting defendant of the crimes of robbery in the first degree and robbery in the second degree.

Defendant was charged by indictment with the crimes of robbery in the first and second degrees based upon his participation in the holdup of a convenience store in the City of Albany.
