Appeal from a judgment of the County Court of Chemung County (Buckley, J.), rendered June 30, 2008, upon a verdict convicting defendant of the crimes of attempted assault in the first degree, attempted assault in the second degree, criminal use of a firearm in the second degree and criminal possession of a weapon in the second degree (two counts).
