The respondent employer was brought before the National Labor Relations Board to answer a complaint that its inauguration of a premium pay plan during the term of a collective agreement, without prior consultation with the union representing its employees, violated the duties imposed by §§ 8 (a)(5) and (1) of the National Labor Relations Act. The Board issued a cease-and-desist order, rejecting the claim that the respondent’s action was authorized by the collective agreement.
