This is an action of tort by the administrator of the estate of Marie Falzone, who was the plaintiff’s minor daughter, to recover for her death and conscious suffering alleged to have been caused by the negligent operation of a truck owned by the defendant and operated by his agent. The answer sets up a general denial and contributory negligence. The jury returned a verdict for the plaintiff.
