At issue in this diversity action is whether plaintiffs claim for breach of contract is barred by the statute of limitations. Ordinarily, a federal court in Virginia must apply Virginia’s statute of limitations to state law claims in diversity actions. Yet, pursuant to Virginia’s “borrowing statute,” 1 a breach-of:contract claim is governed by the statute of limitations of another state if that state’s law governs the contract and its statute of limitations is more restrictive than Virginia’s.
