MEMORANDUM OPINION

This matter is before the Court on Plaintiffs and Third-Party Defendants’ Motion for Partial Summary Judgment [Dkt. 123] (“Plaintiffs Motion”) and Defendants’ Motion for Summary Judgment [Dkt. 114] (“Defendants’ Motion”)(collectively, “the Motions”). For the following reasons, this Court will rule on the Motions as follows.
I. Background
This case arises out of a business dispute involving alleged acts of trademark and trade name infringement, as well as breach of contract.
