—In a proceeding pursuant to CPLR article 78, inter alia, to compel the respondents to appoint the petitioner to the position of police officer in the Nassau County Police Department, petitioner appeals from a *627judgment of the Supreme Court, Nassau County, entered April 1, 1977, which dismissed the petition.
