In a proceeding pursuant to CPLR article 78, inter alia, to compel the County of Nassau, the Nassau County Civil Service Commission, and the Nassau County Police Department to appoint the petitioner to the position of police officer, the petitioner appeals from an order and judgment (one paper) of the Supreme Court, Nassau County (LaMarca, J.), entered August 23, 2004, which granted the respondents’ pre-answer *471motion to dismiss the petition as untimely and for failure to state a cause of action, and thereupon dismissed the proceeding.
Ordered that the order and judgment is affirmed, with costs.
