The complaint contains three counts for (1) damages claimed for personal injuries alleged to have resulted from the negligent acts of the defendant as therein set forth; (2) an amount claimed to have been agreed to in a written compromise settlement between the plaintiff and the defendant, and (3) an amount claimed to have been agreed to in an oral compromise settlement between the plaintiff and the defendant. In taking judicial notice of the background of this case, it appears that it was first before the Appellate Division of the Circuit Court on April 6, 1964, on an appeal by the defendant…
