Huebotter v. Follett
California Supreme Court
1Opinion of the CourtSchauer, J.
Plaintiff appeals from a judgment entered upon a verdict for defendant in this action for personal in*767juries sustained by plaintiff when an automobile in which he was riding struck an illegally parked truck. Defendant owned and was operating such automobile at the time of the collision. Plaintiff urges that asserted errors of the trial court in giving and in refusing various instructions to the jury necessitate a reversal of the judgment. We have concluded that prejudicial error did occur in connection with certain of such instructions and that the judgment must be reversed.
