The question involved in this case is whether stex>s, necessary to confer jurisdiction upon the district court in a probate appeal, were taken by the appellant in the county court. The question arose in the following manner: On July 25, 1937, the county court of Seminole county entered a decree determining the names and identity of the heirs of Wallace Cully, deceased, and it was therein determined that Newman Harjo was not an heir.
