On October 8, 1927, Erni C. Waterman executed an instrument purporting to be his last will and testament. The validity of this instrument is challenged on the ground that he was not then of sound mind, and that he was unduly influenced to make the same by his daughter, Jessie Hobbs, and his housekeeper, Mrs. Mildred Paul. The trial below was by jury, and resulted in a verdict in favor of the instrument. The case is here on exceptions saved by the contestant.
