Plaintiff Michele Taylor is the administra-trix of the estate of Mr. Joseph E. Keane. She filed a claim in this Court seeldng: (1) judicial review of the benefits awarded to Mr. Keane under the Federal Employees’ Compensation Act (FECA), 5 U.S.C. §§ 8101-8152 (2006); and (2) an order by the Court to the Secretary of Labor (Secretary) for unpaid FECA benefits to be paid to the estate of Mr. Keane. The Government responded with a Motion to Dismiss pursuant to RCFC 12(b)(1), seeking dismissal of Plaintiffs claim for lack of subject matter jurisdiction. After…
