MEMORANDUM AND ORDER
NEAHER, District Judge.
This action arises out of an alleged contract for the fabrication and delivery of wardrobe units. Plaintiff claims in its complaint that defendant, a New Jersey corporation, submitted a bid to it for the work, which it relied on in submitting its own bid for award of a public works contract by the Facilities Development Corporation of the State of New York.
