Defendant had judgment on its demurrer to plaintiff’s complaint, from which plaintiff appeals.
It is alleged in the complaint that plaintiff is the holder and owner, by assignment thereof, of certain certificates of purchase, issued by the state, for lands situated in defendant county selected, in lieu of certain other lands, in the sixteenth and thirty-sixth sections; that plaintiff, for the fiscal years, ending respectively June 30, of 1905, 1906 and 1907, “delivered to the assessor of said county his sworn statement, setting forth that he was the owner of the lands described respectively in…
