This action was instituted for the recovery of the purchase price of certain shares of corporate stock, which it is alleged the defendant agreed to purchase from the plaintiff. Judgment was rendered in favor of the plaintiff and the defendant has appealed.
The agreement upon which the action is based was in writing signed by each of the parties thereto, and provided that the plaintiff “agrees to sell” to the defendant, and the defendant “agrees to buy” of the plaintiff, two hundred shares of stock of the Gibson Oil Company, a corporation, for the sum of ten thousand dollars ($10,000) at the…
