Plaintiffs are milk dealers, within section 103 of the Milk Control Law approved April 28, 1937, P. L. 417, 31 PS 700j-101 et seq., engaged in business in the city of Pittsburgh. They filed this class bill against the School District of Pittsburgh and its treasurer to restrain them from collecting mercantile taxes based on plaintiffs’ respective sales of milk products. The defendants answered on the merits; after trial, the injunction was granted and this appeal by the school district followed.
