OPINION AND ORDER
SPIEGEL, District Judge:
This matter is before the Court on defendant’s motion for a judgment notwithstanding the verdict or in the alternative for a new trial (doc. 95), plaintiffs’ memorandum in opposition (doc. 109), and the defendant’s reply (doc. 113). For reasons to be discussed, the Court finds as follows:(1) With respect to plaintiff Cain, the motion is denied.(2) With respect to plaintiff Merkel, the motion is denied insofar as it pertains to Merkel’s federal claim.
