Bell, Judge:

This is an action for breach of contract for failure to provide agreed engineering services in connection with the construction of a water and sewer system for a mobile home subdivision. Foxfire Village, Inc., the owner and developer of the project, sued Black & Veatch, Inc., the consulting engineers, alleging breach of contract, breach of contract accompanied by a fraudulent act, fraud, negligent misrepresentation, and breach of fiduciary duty.
