The plaintiff in error, the Cincinnati Traction Company is a corporation engaged in operating a street railway in Cincinnati, Ohio. On March 10, 1906, the appellee, Harry Reach, was a passenger aboard one of appellant’s cars. He was standing on the rear platform of the car, and while it was in motion he fell or was thrown from the platform of the car into the street and was injured. Suit was instituted by the defendant in error to *550recover damages for the injuries sustained. The case was tried before the court and jury, resulting in a verdict for the defendant in error…
