GRAY, Circuit Judge.

The action in this case was brought by the plaintiff in error against the defendant in error, to recover damages for personal injuries which the plaintiff alleged she sustained while a passenger on defendant’s railroad. The declaration is in two counts, the first charging that the plaintiff, having purchased a ticket from the defendant entitling her to be carried as a passenger from East Orange to Hoboken, boarded a car of the defendant company for that purpose as a passenger, at the station maintained by defendant at East Orange, and that defendant, failing in its duty,…
