The Louisville and Nashville Railroad Company hereinafter called defendant has appealed from a judgment rendered against it in favor of the plaintiff in the sum of $5,000 in the circuit court of Sumner county, Tennessee. The plaintiff’s declaration contained two counts, by the first count plaintiff alleged that on the 20th day of August, 1926, he was a passenger on the train operated by the defendant between Louisville, Kentucky and Gallatin, Tennessee. The plaintiff purchased a ticket for Gallatin, Tennessee, boarded a passenger coach of the defendant in Louisville, Kentucky, about 10 p. m.…
