This is a criminal appeal from a jury verdict finding the appellant guilty of attempted burglary in the second degree as provided in K. S. A. 21-101 and K. S. A. 21-520.

The appellant’s car was found on the premises of a service station shortly after 1:00 a. m. on March 24, 1969, by Dean Strickland, the owner and operator, who was alerted by an electric alarm system operating between the station and his home located about one-half mile west of the station.
