This is a direct appeal in a criminal action in which the defendant-appellant, Mark Mims, was convicted of first-degree murder under K. S. A. 21-3401. The homicide occurred during the commission of a robbery. The facts involving the commission of the robbery and homicide were undisputed and were essentially as follows: At approximately noon on October 28, 1974, three black males entered an automobile repair garage in Kansas City, Kansas.
