The following facts are agreed to: On November 4, 1925, Mrs. Mary Ross Chipley died, leaving of force her last will and testament. She named Wm. G. Ross as executor of such will — which was probated in Richland County — and also appointed, in the event of the death of Wm. G. Ross or of his refusal to serve, T. W. Ross to act in that capacity; and further, in the event of the death of T. W. Ross or of his refusal to accept the appointment, she named W. C. Beacham, the plaintiff herein, as such executor. Wm. G.
