The facts out of which this controversy arose are fully set out in the Court’s opinion reported in 187 S. C., 398, 197 S. E., 369, 374. On that appeal the judgment of the Court below was modified in certain respects- and the case remanded for further proceedings consistent with the opinion. The Master thereafter held several references and duly made his report on October 10, 1938, to which exceptions were taken by the plaintiff.
