This was an action brought by the appellee, Herbert Davidson, to recover damages for an injury to his right hand, received while employed in the factory of the New Albany Box and Basket Company.

The complaint was in one paragraph. The appellant appeared specially and filed an answer in abatement in two paragraphs, in the form of a plea to the jurisdiction of the Floyd Circuit Court, for the reason that the cause of action set forth in the complaint was covered by the provisions of the Indiana Work*58men’s Compensation Act, and therefore the Floyd Circuit Court had no jurisdiction in an action at…
