This was an action on the case in the circuit court of Tazewell county by Louis Crooks, the appellee, against the Tazewell Coal Company, appellant, to recover damages for an injury claimed to have been sustained by him on May 28, 1912, while in the employ of appellant in its coal mine near the city of Pekin, in said county. The declaration consists of two counts.
