The Appellate Court, in deciding this case, delivered an opinion, which is, in part, as follows:
“The theory of the defendant is that the carriage had cleared the track and was at a safe distance before the train was moved up to and partly passed it, and that, while the train was slowly moving along, the plaintiff’s horse became unmanageable and backed or plunged the carriage against the train, whereby the injuries resulted.
