Appellee filed suit against appellant in the Circuit Court of Madison county, to recover damages for personal injuries sustained by him on November 18, 1914, while working for appellant in its coal mine at Livingston, Illinois.
The original declaration consisting of two counts was filed September 16, 1916. The first count was based upon the Mining Act. The second count averred common-law negligence, and whether this count stated a cause of action is one of the questions presented for consideration.
