Appeal from a judgment of the superior court for Yakima county, Preble, J., entered August 4, 1908, upon the verdict of a jury rendered in favor of the plaintiff, in an action on a policy of fire insurance.

The respondent, the plaintiff below, commenced this action to recover from the appellant the amount of loss sustained on account of the burning of his stock of goods, which had theretofore been insured by the latter against loss by fire. From a judgment entered upon a verdict in favor of the respondent, this appeal is taken.

The complaint avers, that on the 5th day of September, 1906, the appellant, a corporation organized and doing a fire insurance business in the state of Washington, issued to respondent its policy, whereby it insured his stock of goods against loss by fire in the sum of…
