ORDER OF COURT

CAMP, District Judge.

This matter is before the Court on plaintiffs’ Motion for Summary Judgment, and defendant’s Motion for Summary Judgment. For the following reasons, the Court GRANTS plaintiffs’ Motion for Summary Judgment. The Court DENIES defendant’s Motion for Summary Judgment.

I. BACKGROUND

Plaintiffs bring this suit pursuant to 42 U.S.C. § 1983, claiming that defendant’s denial of an alcohol beverage permit was in violation of their Fourteenth Amendment due process and equal protection rights and caused them to incur damages. Plaintiffs also seek for the Powder Springs…
