This is an original proceeding for writ of habeas corpus brought herein by Harrold Lee Motley wherein he seeks release from the custody of O. P. Bur- ford, warden of the State Penitentiary at McAlester, Okla. In his petition he alleges that the canse of his restraint is that on the 27th day of October, 1936, he wa.s sentenced by Honorable Roy Paul, then district judge of Atoka county, Okla., to serve a term of life imprisonment in the State Penitentiary at McAlester for the crime of murder.
